Within 60 days, DGS should either make a request to the State Personnel Board to take disciplinary action against the supervisor or attempt to work with the supervisor's current state employer to take disciplinary action.

DGS reported that in coordination with the supervisor's employer, it drafted a disciplinary action that would have dismissed the supervisor from state service. However, just prior to the employer serving the action, the supervisor resigned.

DGS submitted a request to the State Personnel Board (SPB) to take disciplinary action against the supervisor, but SPB denied the request for various legal reasons. DGS stated that it planned to contact the supervisor's current state employer to pursue disciplinary action.

DGS should determine whether any overpayments should be recouped from the supervisor and office technician for their time abuse. If warranted, DGS should attempt to recover overpayments made or adjust their leave balances within 60 days to account for their missed work time.

DGS reported that after gathering and carefully analyzing all the relevant records available, it determined that it lacked sufficient evidence to take disciplinary action against the technician. Therefore, it will not attempt to recoup any overpayments.

DGS stated that it is still working to complete its analysis of the office technician's time abuse. It also stated that the supervisor resigned from state service prior to the supervisor's current employer's attempt to serve disciplinary action. DGS does not intend to pursue further action against the supervisor.
