Recommendation #14 To: Corrections and Rehabilitation, Department of

To protect the best interests of the State, all contracts that Corrections enters into with medical registries should include Business Associate Agreements in all contracts subject to HIPAA and amend existing contracts to include those agreements.

1-Year Agency Response

The Office of the Receiver agrees with this recommendation and has developed an exhibit that includes standard language pertaining to HIPAA. The Office of the Receiver stated that its Plata Contract Branch has developed a public-access Web site with anticipation that the HIPAA exhibit and other standard documents attached by reference will be available for public use beginning in September 2008. (See 2009-406 p. 41)
